International Trademark Association Leadership Works to Fight Sale of Counterfeit Products

The International Trademark Association (INTA) Leadership Meeting continues through November in Orlando, Florida. The purpose of the Leadership Meeting is to schedule essential INTA sessions to help further committee work and plan ahead. The meetings are coupled with networking opportunities for those in the trademark and IP industry.
CONSOR Chairman Weston Anson is a member of the Internet Committee – Online Trademark Use Subcommittee and is working on the Auctions Working Group, and in particular the issue of counterfeit products being sold on online consumer marketplaces.
Anson points to an issue of The Licensing Letter where the Mary Engelbreit Studios submitted an open letter asking to:
“assist us in protecting and monitoring use of artwork and trademarks. If you have not received our express approval via a License Agreement to use our artwork and/or trademarks, please don’t use them. If you see others using our artwork or our trademarks without our approval, please let us know so that we can take appropriate action. The only authorized web platforms for our products are the Mary Engelbreit Retail website, or those websites of our licensees or national retailers. If you see products showcased on eBay, Etsy or similar platforms, please know these are unauthorized sellers of unlicensed products…” - The Licensing Letter, Vol. XXXVI, No. 12, June 18, 2012
The type of problems that Engelbreit and other licensors have had in encountering the sale of counterfeit products is what Anson and other members of INTA hope to address at these meeting. These issues have come to the forefront due to the explosion of online consumer websites and the ability to share these avenues through social media platforms.
The INTA Internet - Online Use Subcommittee Auctions Working Group has been working to identify such online consumer marketplaces in order to monitor the sale of unlicensed products, and to help licensors maintain control of their IP.
To help licensors, the group is asking the public to help them develop methods to protect IP owners. Additional information is requested on where does the public see unlicensed or unauthorized products? Also, how can the licensing community help each other keep unauthorized or unlicensed products off of these online consumer marketplaces?
Anson is collecting this information for the working group, which can be sent to him at wanson(at)consor(dot)com. Anson says the goal is that “We hope to develop useful solutions for IP owners and help halt the onslaught of unlicensed products in the global marketplace.”
